1. Scope & Provider
1.1 Provider: These Terms of Service govern the use of the cloud-based software platform for managing, controlling and billing voice-based communication (Software as a Service) "FluffyCall", provided by:

1.2 Scope: These Terms apply exclusively to business customers (companies, sole proprietors, freelancers, legal entities under public law). Consumer use is excluded.
1.3 Deviating Terms: Deviating, conflicting or supplementary general terms and conditions of the customer shall not become part of the contract unless expressly agreed to in writing.
2. Services
2.1 Description: FluffyCall provides a Software-as-a-Service (SaaS) platform that enables business customers to use VoIP services. FluffyCall does not provide its own telecommunications services under the Telecommunications Act (TKG), but exclusively provides cloud-based software for using external telecommunications services from third-party providers. VoIP infrastructure is provided exclusively by third-party providers (see §6). FluffyCall uses VoIP phone numbers from Telnyx LLC as technical infrastructure for outbound calls. The selection of the sender number is automatic and optimized based on the destination country of the call (Smart Routing). FluffyCall uses a pool of German and US phone numbers for this purpose. The technical sender numbers used within the software serve exclusively for the operation of the platform and do not represent phone numbers individually assigned to the customer. Use is browser-based without additional software installation.
2.2 Features: FluffyCall enables:
- Outbound calls to over 218 countries
- Browser-based usage (Chrome, Firefox, Safari, Edge)
- Call history access
- Electronic invoicing
2.3 No Guarantees: FluffyCall is provided according to the state of the art. There is no entitlement to:
- Specific functions or features
- Availability in specific countries
- A specific voice quality
- Uninterrupted availability
3. Registration & Contract
3.1 Contract Formation: The contract is formed through successful registration and activation of the customer account by FluffyCall.
3.2 Registration Requirements: Upon registration, the customer confirms:
- Acting as a business user (B2B)
- Providing complete and truthful information
- Having accepted the Terms of Service and Privacy Policy
3.3 Rejection: FluffyCall reserves the right to reject registrations without stating reasons.
3.4 Access Credentials: The customer is obligated to keep access credentials confidential and protect them from unauthorized access. The customer is liable for all activities conducted through their account.
4. Prepaid System & Credit
4.1 Prepaid Principle: FluffyCall operates exclusively on a prepaid basis. Calls can only be made if sufficient credit is available in the customer account.
4.2 Credit Top-Up: Credit can be topped up via available payment methods in the dashboard. Available packages:
- $25
- $50
- $100
- $200
4.3 Validity: Credit has no expiration date and remains available on the customer account indefinitely as long as the contract exists.
4.4 No Refunds: There is no entitlement to a refund of remaining credit. The credit serves exclusively for the use of software services and does not constitute legal tender, e-money, or a payment instrument.
5. Pricing & Billing
5.1 Pricing Structure: Billing is usage-based per call minute. Current prices are visible in the cost calculator on the website and may vary by destination country.
5.2 Price Changes: FluffyCall reserves the right to adjust prices at any time with effect for the future. Price changes will be communicated to customers by email.
5.3 Payment Processing: Payment processing is handled through the external payment provider Stripe. FluffyCall does not store credit card data.
5.4 Invoicing: Customers receive a monthly electronic invoice for calls made. Invoices can be downloaded as PDF in the dashboard.
5.5 Currency: All prices are in US Dollars (USD) for fluffycall.com or Euros (EUR) for fluffycall.de, plus applicable statutory VAT (if applicable).
6. Services & Third-Party Providers
6.1 External Carriers: VoIP infrastructure is provided exclusively by Telnyx LLC (311 W Superior St #500, Chicago, IL 60654, USA). All call data (Call Detail Records) is stored in Germany (EU). FluffyCall only provides the software interface to use these services. FluffyCall has no control over:
- Network quality and voice quality
- Call routing
- Availability of external telecommunications networks
- Disruptions in third-party networks
6.2 No Liability for Third Parties: FluffyCall assumes no liability for failures, disruptions or quality defects attributable to external service providers or their infrastructure.
6.3 Technical Requirements: To use FluffyCall, customers need:
- A modern web browser (Chrome 90+, Firefox 88+, Safari 14+, Edge 90+)
- A stable internet connection (at least 1 Mbps)
- A functioning microphone
- Microphone permission in the browser
7. Customer Obligations
7.1 Lawful Use: The customer commits to using FluffyCall exclusively in accordance with applicable laws. In particular, the following are prohibited:
- Sending spam or unwanted advertising calls
- Harassment, threats or fraud
- Illegal activities of any kind
- Circumvention of security measures
- Automated mass dialing (except with prior approval)
7.2 Responsibility: The customer is solely responsible for:
- All calls made through their account
- The content of their calls
- Compliance with data protection regulations
- Ensuring their own technical infrastructure
7.3 Confidentiality: The customer commits to treating their access credentials confidentially and protecting them from unauthorized access.
8. Suspension & Misuse
8.1 Right to Suspend: FluffyCall is entitled to suspend the customer's account immediately and without prior notice in case of:
- Violation of these Terms
- Suspicion of fraud or misuse
- Illegal activities
- Endangering system security
- Payment default or refusal
8.2 Fraud Protection: FluffyCall employs automatic security systems to prevent fraud:
- Blocklists for known fraud numbers
- Geo-blocking for high-risk countries
- Rate limiting
- Automatic monitoring of suspicious activities
8.3 No Liability: FluffyCall is not liable for damages resulting from justified suspension. In case of unjustified suspension, liability is limited to reactivation of the account.
9. Availability & Maintenance
9.1 No Guarantee: FluffyCall does not guarantee uninterrupted availability of the service. There is no entitlement to a specific availability quota.
9.2 Maintenance: FluffyCall is entitled to perform maintenance work that may lead to temporary restrictions or interruptions. Planned maintenance will be announced when possible.
9.3 Disruptions: In case of disruptions, FluffyCall will endeavor to resolve them as quickly as possible, without any legal entitlement thereto.
10. Liability
10.1 Limitation of Liability: In cases of simple negligence, FluffyCall is only liable for breach of essential contractual obligations (cardinal obligations) and limited to the typical, foreseeable damage.
10.2 Exclusion: In particular, FluffyCall is not liable for:
- Lost profits
- Indirect damages or consequential damages
- Data loss (unless caused by gross negligence)
- Damages caused by external carriers or third-party providers
- Damages due to force majeure
10.3 Amount Limitation: In case of simple negligence, liability is limited to the typically foreseeable damage and in amount to the fees paid by the customer in the last month.
10.4 Mandatory Liability: Unaffected remains liability for damages from injury to life, body or health, as well as liability under product liability law.
11. Term & Termination
11.1 Term: The contract runs for an indefinite period.
11.2 Ordinary Termination: Both parties may terminate the contract at any time with 14 days' notice to the end of the month. Termination requires text form (email to service@fluffycall.com is sufficient).
11.3 Extraordinary Termination: The right to terminate without notice for good cause remains unaffected. Good cause exists particularly in case of:
- Serious violation of these Terms
- Payment default of more than 30 days
- Insolvency of either party
11.4 Consequences of Termination: After contract termination:
- The account will be deactivated
- There is no entitlement to a refund of remaining credit
- No further calls can be made
- Call data will be deleted after 30 days
- Invoices can still be downloaded for 10 years (retention obligation)
12. Privacy
12.1 Privacy Policy: For the processing of personal data, the provisions of the Privacy Policy apply.
12.2 Responsibility: Insofar as FluffyCall processes personal data on behalf of the customer, this is done as a processor within the meaning of Art. 28 GDPR.
12.3 No Call Recording: FluffyCall does not record call content and has no access to it. Only connection data (metadata) is stored.
12.4 Call Logging & Connection Data: FluffyCall stores connection data (metadata) of each call for billing and legal purposes. Stored data includes: called number, date, time, duration, cost, destination country, call status, technical caller number, user ID, and unique call ID. Retention is carried out for the legally required duration in accordance with applicable telecommunications and data protection regulations. Data is automatically deleted. You can view your call history in the dashboard at any time. Data processor is Telnyx LLC (USA), data storage takes place on EU servers in Germany.
13. Changes to Terms
13.1 Right to Change: FluffyCall reserves the right to change these Terms with effect for the future.
13.2 Notification: Changes will be communicated to customers at least 30 days before they take effect by email.
13.3 Right to Object: Customers may object to the changes within 30 days of notification. The objection is deemed a termination effective at the time the changes take effect. If no objection is made, the changes are deemed accepted.
14. Final Provisions
14.1 Applicable Law: The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.
14.2 Jurisdiction: The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Berlin, provided the customer is a merchant, legal entity under public law or special fund under public law.
14.3 Severability Clause: Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
14.4 Written Form: Changes and supplements to these Terms require text form (e.g. email).
