§ 1 Scope

These Terms of Service (ToS) apply to the use of the FluffyCall platform, a service for internet-based telephony (VoIP). FluffyCall enables registered users to make phone calls via the internet.

By registering and using FluffyCall, you agree to these Terms of Service. Deviating terms from the user are not recognized unless we have expressly agreed to them in writing.

§ 2 Contracting Parties and Contract Formation

2.1 Contracting Parties

3.2 Availability

We strive for high service availability but cannot guarantee uninterrupted accessibility. Maintenance work will be announced when possible.

3.3 Quality

Call quality depends on various factors, particularly your internet connection. We recommend a minimum bandwidth of 1 Mbps for optimal voice quality.

§ 4 Credit and Prices

4.1 Prepaid System

FluffyCall operates on a prepaid basis. You first load credit onto your account and can then make calls until the credit is used up.

4.2 Credit Top-up

Top-up is available via the following payment methods:

The minimum top-up amount is $5.00. Credit is credited in real-time (except for bank transfers, which may take 1-3 business days).

4.3 Bonus Program

For top-ups of $20.00 or more, you automatically receive a 25% bonus on the loaded amount (e.g., top up $20 = receive $25 credit).

4.4 Prices

Current prices for calls to various countries can be viewed on our website under "Pricing". Prices are calculated per minute and billed per second.

4.5 Validity Period

Loaded credit does not expire and can be used indefinitely as long as your account is active.

§ 5 Billing

5.1 Call Billing

Billing is done per second according to the applicable rates for the destination country. The price is deducted from your credit at the start of the call.

5.2 Billing Overview

You can view a detailed overview of your calls and credit movements in your dashboard at any time.

5.3 Invoices

For credit top-ups, you automatically receive an invoice via email.

§ 6 User Obligations

6.1 Access Credentials

You are obligated to keep your access credentials secret and protect them from third-party access. We must be informed immediately if misuse is suspected.

Important: FluffyCall is not suitable for emergency calls. In case of emergency, always use the appropriate emergency numbers for your location (e.g., 911 in the US, 112 in Europe).

§ 7 Suspension and Termination

We reserve the right to suspend your account in case of violations of these Terms of Service, fraudulent behavior, or reasonable suspicion of misuse.

7.2 Termination

Both parties can terminate the contract at any time without notice. Termination by you is done by deleting your account in the dashboard or by email to [YOUR EMAIL].

7.3 Credit Upon Termination

Upon termination by you, remaining credit will be refunded upon request if it amounts to at least $5.00. Bonus credit is excluded from refunds.

§ 8 Data Protection

§ 9 Liability

9.1 Limitation of Liability

We are only liable for damages resulting from intent or gross negligence. This does not apply to injury to life, body, or health.

We assume no liability for outages or quality degradation caused by factors beyond our control (e.g., your internet connection, issues with third-party providers).

You are solely responsible for the content of your calls. We are not liable for illegal use by you.

§ 10 Changes to Terms of Service

We reserve the right to change these Terms of Service. You will be informed of significant changes at least 4 weeks before they take effect via email. If you do not object to the changes, they are considered accepted.

§ 11 Dispute Resolution

We are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

§ 12 Final Provisions

12.1 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

12.2 Place of Jurisdiction
